Benton and Summers Obtain Directed Verdict in Consumer Protection Case Against Builder
The firm obtained summary judgement for its client and other parties settled out. The summary judgment was appealed, and the Court of Appeals upheld the summary judgment on warranty and contract, but remanded the case on the issue of violation of TCPA. Following a trial limited to the issue of violation of TCPA, Chancellor Arnold Goldin found that Sovereign Homes did not have any knowledge, and could not have violated the TCPA. The case was dismissed.
